Consular Processing

Consular processing is a method used to obtain a visa at a U.S. consulate or embassy abroad for individuals who are seeking to immigrate to the United States or obtain certain nonimmigrant visas (e.g., tourist, student). This process is typically utilized by those residing outside the United States.

Process Overview:

  • Immigrant Visa Petition Approval: The first step for immigrant visas is the approval of an immigrant visa petition filed with USCIS by a U.S. citizen or lawful permanent resident sponsor on behalf of the intending immigrant.
  • National Visa Center (NVC) Processing: Once the immigrant visa petition is approved, the case is transferred to the National Visa Center (NVC) for processing. The NVC collects necessary documentation, fees, and forms, and conducts a review of the case.
  • Medical Examination: The applicant undergoes a required medical examination by a designated physician.
  • Consular Interview: The case is forwarded to the appropriate U.S. consulate or embassy abroad, where the applicant is scheduled for an interview. A consular officer reviews the documentation, conducts an interview, and determines whether to approve the visa.
  • Visa Issuance or Denial: If approved, the applicant receives the visa and instructions for travel to the United States. If denied, the applicant may be provided with reasons and, in some cases, options for appeal.
